What can I do About my Immigration Matters Today?

If you have a family relationship that allows you to file for immigration benefits, now may be the time. If you are eligible, or become eligible soon, for Naturalization you should file as soon as you can. If you have employees that you want to sponsor or are in the process of sponsoring, now is not the time to delay. There is always a line and processing times are always longer than anyone wants to wait for but not moving forward now could prove even longer in the end.

Who Can You Sponsor or Who Can Sponsor You?

Familial relationships include Lawful Permanent Residents (green card holder) spouses, children, and unmarried sons and daughters (over the age of 21). Additionally, the spouses, children, parents, unmarried sons and daughters (over the age of 21), married sons and daughters, and brothers and sisters of U.S. citizens are also eligible for permanent residence. Please note that these processes are multi-step and each category has specific requirements and benefits. An individual who is eligible to be sponsored may not be eligible to remain in the U.S. to await the issuance of the permanent residence (green card).

It is very important that you seek assistance of an immigration attorney who can review the full situation and provide the proper advice and guidance so that the ultimate goal – reunification in the United States with your family member! – is reached.

Are You Eligible to Naturalize?

As a Lawful Permanent Resident, you may be eligible as early as 3 years from the date you received Permanent Residence if you received your permanent residence through marriage to a U.S. citizen and remain in a valid marriage. If you received your permanent residence through any other manner – employment, an LPR spouse or parent or any other U.S. citizen family member, then you will be eligible on the five (5) year anniversary of the approval of your permanent residence.

As with all immigration processes, there are additional requirements that must be met. It is highly recommended that you consult with a knowledgeable immigration lawyer who can review your circumstance and help ensure that you will become a U.S. citizen!

What Can You Do Now?

In these very important matters, it does not matter how similar your situation seems to your friends, family, or stories that you have read or heard. The best way to be sure that your case will process easily and properly is to talk with a professional.

As we have seen and continue to see, everything is changing in our daily lives. It is no different with immigration in the U.S. It’s true that pursuing a case, with or without counsel, will be expensive but it is an investment. It’s an investment in having your family together. It’s an investment in expanding your rights and responsibilities in the U.S. with the right to vote, obtain and travel on a U.S. passport, and sponsor additional family members to join you in the U.S.

With the length of processing times generally, and now the additional things that we don’t know, there are only some things that we can still control. Getting in line now to see to it that your family processes or that you get citizenship as soon as possible is the best plan.
